In execution of a Credit Line Deed of Trust, dated July 16, 2025, in the original principal amount of $70,000,
recorded in the Clerk's Office of the.Campbell County Circuit Court as instrument 250003759, in the original
principal balance of $70,000, undersigned Substitute Trustee will offer for sale at public auction in front of the
Circuit Court for Campbell County, located at 732 Village Highway, Rustburg, VA 24588 on the
18th day of September 2026 at 3:30 P.M.,the premises described in the aforementioned Credit Line Deed of
Trust, commonly known as 1952 Rainbow Forest Dr., Lynchburg, Virginia and more particularly described as
follows:
THE LAND REFERRED TO HEREIN BELOW IS SITUATED IN THE COUNTY OF CAMPBELL, STATE OF
VIRGINIA, AND IS DESCRIBED AS FOLLOWS:
ALL OF LOTS 5 AND 7 ON A MAP OF THE SCOVILLE PROPERTY, MADE BY R. S. PAYNE, SURVEYOR,
WHICH PLAT OF SURVEY IS RECORDED IN THE OFFICE OF THE CLERK OF THE CIRCUIT COURT OF
CAMPBELL COUNTY IN DEED BOOK 48, PAGE 281 , (WHICH MAY BE MORE RECENTLY SHOWN TO
CONTAIN 0.46 ACRE, AND KNOWN AS POPLAR HILLS LOT 2, BLOCK 2, SECTION A).
TERMS OF SALE: The property will be sold "as is" without representation or warranty of any
kind and subject to environmental or other conditions, restrictions, easements, rights of way and
agreements of record affecting same, if any and subject to all matters of record taking priority
over the Deed of Trust. Substitute Trustee shall have no obligation to deliver possession of the
property or any other obligation as to the premises. A deposit of $7,000.00 or ten percent of the
sale price, whichever is lower, in the form of cash, cashier's check, or certified check, is required
at the time of auction. Balance of the purchase price to be paid in cash within fourteen days of
sale, time being of the essence. In the event of default by the successful bidder, the entire deposit
shall be forfeited and applied to the costs and expenses of sale and Substitute Trustee's fee
according to the· Code of Virginia.
All other public charges or assessments, including water/sewer charges to be prorated through
date of sale; those incurred after the sale date, and all other costs incident to settlement to be paid
by the purchaser. In the event taxes, any other public charges have been advanced, a credit will
be due to the seller, to be adjusted from the date of sale at the time of settlement. Sale is subject
to post sale confirmation that the borrower did not file for protection under the U.S. Bankruptcy
Code prior to the sale as well as to post-sale confirmation of the status of the loan with the loan
servicer including, but not limited to, determination of whether the borrower entered into any
repayment agreement, reinstated or paid off the loan prior to the sale or whether other legal
impediment to title exists. In any such event, the sale shall be null and void, and the Purchaser's
sole remedy, in law or equity, shall be the return of the deposit without interest. Additional terms
may be announced at the time of sale.
